COMPETITION TERMS AND CONDITIONS

TERMS AND CONDITIONS OF PARTICIPATION FOR COMPETITIONS – KEEP IT SPOOKY SANTO 2022

1. TERMS AND CONDITIONS OF PARTICIPATION FOR COMPETITIONS

The general terms and conditions of participation apply to all competitions held by PLAION Ltd.. These shall apply in addition to the terms and conditions of participation for the respective competition. By participating, each participant shall recognise these terms and conditions of participation as well as the Terms and Conditions of participation and deadlines named separately in the case of the individual competitions.

ENTERING A COMPETITION IS FREE OF CHARGE AND DOES NOT IMPLY ANY PURCHASE OBLIGATION, UNLESS STATED OTHERWISE IN THE TERMS AND CONDITIONS OF A SPECIFIC COMPETITION.

2. ORGANIZER

PLAION Ltd., 2nd Floor, Building 1410, Arlington Business Park, Theale, Reading, RG7 4SA, United Kingdom (“PLAION” or “Deep Silver”).

3. PARTICIPATION

a. The Competition is free to enter and is open to all countries except where prohibited by law. With the exception of employees of PLAION, their immediate families, representatives or agents or anyone else connected with this Competition. Participants must be over the age of 18 to enter. This competition is not open to Russia or Belarus or other countries where such competitions are restricted. The Competition will run from October 27th 2022 until October 31 2022 at 11:59pm BST.

b. Provided that nothing else has been indicated, a person enters the competition by doing the following on Twitter, Reddit or in the official Discord:

Twitter: Enter the competition by following @saintsrow on Twitter and responding to the original competition prompt tweet from Saints Row twitter account. To be considered eligible your tweet must contain a screenshot of your entry and the hashtag #KeepItSpookySanto. Your screenshot must be clearly discernible, picture of your creation on the screen is not considered a valid entry.

Discord: Enter the competition by becoming a member of the Saints Row Official Discord (discord.gg/saintsrowofficial), accepting the rules and entering their spooky screenshot into the #spooky-santo-competition channel. Your screenshot must be clearly discernible, picture of your creation on the screen is not considered a valid entry.

Reddit: Enter the competition by becoming a member of the r/saintsrow Subreddit (https://www.reddit.com/r/SaintsRow), accepting the community rules and entering their spooky screenshot under the competition announcement post. Your screenshot must be clearly discernible, picture of your creation on the screen is not considered a valid entry

By submitting your entry you agree to be bound by these terms and conditions.

If you do not wish to participate you can withdraw from the competition at any times by sending us a private message or email. We will not use your data for the competition.

Each Participant will accordingly be deemed to have read and understood these terms and conditions and accepted them in full together with any decisions taken by the Organizer and/or the selected jury.

c. One person may take part in a raffle or competition a multiple times with different creations as the entries.

d. Participation via third parties that act as a commercial broker of raffles, competitions and/or raffles shall be ruled out.

4. WINNER ANNOUNCEMENT AND PRIZE NOTIFICATION

a. The Winner will be chosen by a panel of Deep Silver staff, the participant will receive the prize as stated in the initial Competition Announcement post.

b. The winner(s) will receive 1 set of Saints Row Hot Sauces and 1 Notorious Edition copy of Saints Row on either Xbox or PlayStation offered on PEGI or ESRB regions. PC is not offered in this competition and there is no PC alternative available. There will be a total of 6 winners for the duration of this competition. 2 will be allocated to users in the Saints Row Official Discord, and 2 allocated to users on Twitter and 2 allocated for entries on Reddit.

The prize will be dispatched within a period of 4 weeks of the winner being notified and having provided postage details. Winners will be required to provide a postage address and contact telephone number, failure to do so may result in expulsion from the competition and another winner being selected.

c. The winning posts may be shared as a post on the Saints Row Twitter, Facebook and Instagram accounts. You must state in your responses to winning notification if you give permission to tag your account.

d. The prize is personal and non-transferable. It shall only be awarded to the Winners and can only be claimed for a certain edition by the Winner of the relevant competition. The prize cannot be exchanged for other products, services or cash. The prize is indivisible and can only be accepted as such. Deep Silver retains the exclusive right to choose the winners.

e. Unless indicated otherwise, in the case of several participants and/or several correct final judgments, a determination shall be made based upon the lot.

f. The winners will be notified by e-mail or private message. If the winner does not contact us within a period of four weeks of having received notification, claim to the prize shall be forfeited and a substitute winner shall be determined according to the same process. The winner has the right to refuse the prize by making a written declaration. In this case, claim to the prize shall also be forfeited and a substitute winner shall be determined.

g. By participating in the competition or raffle, the participant agrees to publicly announcing their name.

h. Unless specified otherwise, the prize will be shipped to the winner by mail, after being contacted per e-mail.

i. The end date of the competition is as stated in each original competition prompt Twitter post.

5. EXPULSION FROM THE COMPETITION

a. PLAION shall be entitled to refuse participation without any indication of reasons. Principally, there is no entitlement to participate.

b. In particular, this shall apply in the event of non-compliance with the Terms and Conditions, the use of technical means or other manipulative and/or illicit aid. This shall also apply in the case of making numerous applications for the same person to participate and deliberately providing false personal information.

c. Furthermore, PLAION shall reserve the right to exclude, even retroactively, participants whom have already been accepted at any time, as well the right to deny prizes and demand them back.

d. Employees of PLAION and possible cooperation partners involved, as well as those appointed by them shall be excluded from participation.

6. TERMINATION AND CHANGES

a. Until the prize has been handed over, PLAION shall expressively reserve the right to change the course of the competition and/or modify and the type and scope of the prize as well as replace the prize with something else without any indication of reasons.

b. Furthermore,

aa. PLAION reserves the right to end or cancel competitions without any reason or notification. In particular,

bb. PLAION shall make avail of the possibility if, due to technical reasons (e.g. viruses in computer systems, manipulation or error in hardware and/or software) or due to legal reasons, an orderly execution of the competition cannot be ensured. To the extent that such a termination is caused by the behaviour of a participant, the Organizer shall be entitled to demand compensation from this individual for the damages incurred.

7. DATA PRIVACY

a. In order to be able to participate in a raffle or competition, it is essential to indicate personal information in a complete manner and that this information is free from error. By participating in a competition, the participant expressively gives PLAION his/her consent to save and process the required information. Furthermore, the participant expressively gives his/her consent to transfer the data for the purpose of conducting the competition and to receive Newsletters.

b. The participant may revoke his/her consent to process and save the information at any time and thereby withdraw from participation

c. Upon request, PLAION shall give each participant information free of charge on all personal data that has been saved by it and shall immediately delete this information upon request free of charge. For this purpose, it is sufficient to send a message via e-mail with a list of the information to be deleted.

d. PLAION shall undertake to adhere to legal regulations concerning data privacy

8. LIABILITY

a. PLAION shall be released from all obligations upon handing over the prize.

b. PLAION shall not assume any liability for material defects and defects of title of the prizes that have been donated by cooperation partners.

c. PLAION shall only be liable for damages that have been caused by PLAION or one of its employees with intent, due to gross negligence, or infringement of cardinal obligations. This shall not apply to injuries, death and/or impairments to the health.

d. PLAION take no responsibility for any local tax or duty for the region the competition winner resides in.

9. OTHER

a. Legal action shall be ruled out.

b. If individual provisions should be or become invalid, this shall not affect the validity of the remaining terms and conditions of participation.

c. These terms and conditions of participation can be changed by PLAION at any time without any special notification.

To be considered eligible your tweet must contain a screenshot of your creation from Boss Factory, a hashtag #BossFactory, and Boss Factory share code to your creation. Your screenshot must be clearly discernible, picture of your creation on the screen is not considered a valid entry.

Boss Factory: Following the competition prompt create your character within 7 calendar days from the original competition prompt tweet from Saints Row twitter account. You must tag your creation according to the theme of the prompt with the available Boss Factory tagging functionality.

By submitting your entry you agree to be bound by these terms and conditions.

If you do not wish to participate you can withdraw from the competition at any times by sending us a private message or email. We will not use your data for the competition.

b. The winner will be rewarded with a custom trailer produced by Deep Silver featuring the winning creation.

c. The winning creation will be shared as a post on Saints Row Twitter.

e. Unless indicated otherwise, in the case of several participants and/or several correct final judgments, a determination shall be made based upon the lot.
